How divorce mediation works

Mediation is a process by which an impartial third party, known as a “neutral” or simply a “mediator,” facilitates an agreement between divorcing spouses without need of a trial. In Florida, all divorce cases require the parties to attend at least one mediation session. Prior to the session, the parties and their attorneys should meet several times to prepare. This is because many important issues, such as child custody, child support, alimony and property distribution, may be discussed and negotiated during the meeting. The better each side understands their own and each other’s strengths, weaknesses and demands, the easier the process will be. The mediator’s job is to guide you toward settlement. Each party comes to the mediation with their own points of view and expectations of what they can get out of the process.
